The Will of Mervyn Hay Wake 1884 - 1952         Dated 5 November 1914

This is the last Will of me, Mervyn Hay Wake of Sunderland, Civil Engineer, made this fifth day of November one thousand nine hundred and fourteen.

I appoint my wife, Jesse Eudora, and Leonard Scott Iliff, of Sunderland, Solicitor, Doctor of laws to be Executors of my will.

I give devise and bequeath all my property, real and personal, unto my said wife absolutely.

CODICIL TO MY WILL        Dated 17 March 1949

I MERVYN HAY WAKE of 5 Hillside, Sunderland, in the County of Durham, Civil Engineer, declare this to be a first Codicil to my Will, which Will bears date the Fifth day of November, one thousand nine hundred and fourteen.

IF my wife Jesse Eudora Wake shall predecease me, then:

  1. I APPOINT my son-in-law Robert Harker Aird, and John Iliff of 51 John Street, Sunderland aforesaid to be Executors and Trustees of my said Will, and they and the survivors and survivor of them and other the Executors and Trustees of my said Will are hereinafter referred to as my Trustees.

  2. I GIVE DEVISE AND BEQUEATH all my real and personal estate (hereinafter called "my Residuary Estate") unto my Trustees UPON TRUST for such of my daughters Verna Eudora Higgs and Joan Hay Aird, as shall be living at my death, and if both, in equal shares absolutely.

  3. PROVIDED that if either or both of my said daughters shall die in my lifetime, leaving issue, living at my death, who shall then have attained, or shall thereafter attain the age of twenty one years, such issue shall take per stirpes, and if more than one, equally between them, the share of my Residuary Estate, which his, her, or their parent would have taken if such parent had lived to attain a vested interest.

  4. MY TRUSTEES may until the (unreadable) shall become absolutely vested, postpone the sale, calling in, and conversion of any part of my Residuary Estate for such period as they may, in their absolute and uncontrolled discretion think fit, without being liable for any loss occasioned by such postponement, and may appropriate any part of my residuary estate to or towards the share of any person in the proceeds of sale thereof, and for that purpose may fix the value thereof as they shall think fit, and every such appropriation and valuation shall be binding on all persons interested under this my Will.

  5. THE statutory provisions and powers as to maintenance and advancement shall apply to all infants interested hereunder.

  6. ANY Trustee of my Will, being a Solicitor, or other person engaged in any profession or business, may be so employed to act, and shall be entitled to charge and be paid, all professional and other charges, for any business or act done by him or his firm, in connection with the administration of my estate, and the trusts hereof, including acts which a Trustee not being a Solicitor or other person as aforesaid could have done personally.

  7. IN all other respects, I confirm my said Will.

On the 17th day of June 1952 Probate of this will was granted at Durham to Jessie Eudora Wake of Bandrake House, Colton, near Ulverston, Lancashire, widow, relict of deceased, the surviving Executor.

Mervyn Hay Wake, of 5 Hillside, Sunderland, died on the 11th day of April 1952,
