The Will of Derric Gratwicke Heasman 1896 - 1968     Dated 9 September 1965

This is the Last Will and Testament of me, Derric Gratwicke Heasman, of 65 Cowleigh Road, Malvern, in the County of Worcester.

  1. I HEREBY REVOKE all former Wills and testamentary dispositions made by me.

  2. I APPOINT Julie Garwood-Gowers of The Cottage, Oriel House, St. Asaph, Flintshire, to be the Executor and Trustee of this my Will.

  3. I Direct payment of my debts, funeral, and testamentary expenses.

  4. I GIVE the following pecuniary legacies, free of all duty:

    1. To Diana Oliver, c/o P. L. Oliver, The Cawleys Mill Hayes Stockland, near Honiton, Devon, the sum of Two hundred and fifty pounds.
    2. To Ann Denney, c/o Brook Farm, Martley, near Worcester, the sum of Two hundred and fifty pounds.
      [THE ABOVE TWO LEGACIES ARE REVOKED IN AN ATTACHED CODICIL.]

    3. To Helen Smith, c/o Flat 1, St. Nicholas House, Cowleigh Road, Malvern, the sum of Two hundred and fifty pounds.

  5. SUBJECT to the foregoing, I GIVE DEVISE AND BEQUEATH all my real and personal estate, whatsoever, and wheresoever, to the said Julie Garwood-Gowers, absolutely and beneficially.

  6. IN the event of the said Julie Garwood-Gowers predeceasing me, my Will shall be construed, and take effect, as if clause 2 and 5 had been wholly omitted therefrom, and the following Clauses shall take effect.

  7. I APPOINT Midland Bank Executor and Trustee Company Limited, (hereinafter called "the Company") to be Executors and Trustees of this my Will, AND I DECLARE that the Company is so appointed upon it's standard published conditions, as now in force (as if the same were here set out) with renumeration as provided by those Conditions, and the Company's Standard scale of fees, in force at my death, AND I DESIRE that the firm of Foster & Finley shall be employed as solicitors in connection with my estate, unless the Company sees reason to the contrary.

  8. SUBJECT to clauses 3 and 4 of this my Will, I GIVE DEVISE AND BEQUEATH all my real and personal estate, whatsoever, and wheresoever, to the Company UPON TRUST, to convert the same into money, and to stand possessed of the net proceeds of such sale, calling in and conversion my ready money and any part or parts of my estate for the time being unconverted UPON TRUST for such of the children of the said Julie Garwood-Gowers, who shall be living at the date of my death, and shall attain the age of twenty one years, and in equal shares if more than one absolutely.

  9. The Company shall have the following powers:
    1. TO INVEST in any investments not by law authorized and whether or not involving waste or subject to liability, which the Company may, in it's absolute discretion consider suitable for investment of my estate, or any part thereof, as though the Company were absolute owners of my estate.

    2. To postpone the sale, calling in, and conversion of the whole or any part or parts of my real or personal estate during such time as it shall , in it's absolute discretion, think fit, without being liable for loss.

    3. To retain the whole or any part, or parts, of my estate unconverted, for such time as it shall, in it's absolute discretion think fit, without being liable for loss.

    4. During the minority of any infant beneficiary, to apply any part of the capital or income (or of both capital and income) of the vested, or contingent share, of such beneficiary, for the maintenance, education, advancement or benefit generally of such infant beneficiary, at the absolute discretion of the Company, who may, in it's absolute discretion, either so apply the same itself, or pay the same to any parent, or guardian of such infant beneficiary, to be applied in manner aforesaid, and in such case, the receipt of the person to whom payment is made, shall be sufficient discharge to the Company.

I DERRIC GRATEWICK HEASMAN of 65 Cowleigh Road, Malvern, in the County of Worcester, hereby declare this to be a first Codicil, to my Will, which Will is dated, the ninth day of September, one thousand nine hundred and sixty five.

  1. I hereby revoke sub clauses a and b of Clause 4 of my said Will.

  2. I give the following pecuniary legacies, free of all duty:

    1. To Mrs. Margaret Ester Cundell, of The Manor House, Hampstead, Norris, Berkshire, the sum of Two hundred and fifty pounds.

    2. To Mrs. Audrey Denny, of Wisteria Cottage, Powick, near Worcester, the sum of Two hundred and fifty pounds.

    3. To Mrs. Gladys Betts, of The Manor House, Hampstead, Norris, Berkshire, the sum of Two hundred and fifty pounds.

  3. In all other respects, I confirm my said Will.

On the 4th day of February 1969, Probate of this will, and Codicil, was granted to
Julie Almira Giddings-Pitt Garwood-Gowers, (in the will called Julie Garwood-Gowers), of The Cottage,
Oriel House, St. Asaph, Flintshire, married woman, the sole executrix named in the said will.


Derric Gratwicke Heasman, of 65 Cowleigh Road, Malvern, Worcestershire, died on the 10th day of December 1968,
at The Hay Farm, Eardington, Bridgenorth, Shropshire.

FLINTSHIRE, WALES
After having survived for almost seven centuries, the historic county of Flintshire was abolished in the controversial reorganization of 1974, and was absorbed into the newly created county of Clwyd. Ironically, the county of Clwyd was itself abolished on 31st March 1996, after a brief existence of twenty-two years. At the same time, four new "unitary" authorities were created. These were given the names: Flintshire, Denbighshire, Wrexham County Borough and Conwy County Borough. It is important to realize that the boundaries of the "new" Flintshire and Denbighshire are considerably different from those of the historic counties of the same names.
