The Will of Charles Ralfe Thompson 1895 - 1966 Dated 7 March 1966

This is the last Will and Testament of me, Charles Ralfe Thompson C.M.G., O.B.E. of 14 Pont Street Mews, Chelsea, London S.W.1, Commander Royal Navy (Retired).

  1. I HEREBY REVOKE all prior wills and testamentary dispositions at any time heretofore made by me.

  2. I APPOINT Trevor Bertram Birkett, of 132 High Street in the city of Portsmouth, Solicitor, and Henry Adlam, of 57 Vicarage Road, East Sheen, London S,W,14 (hereinafter called "my Trustees") to be the Executors and Trustees of this my Will.

  3. I BEQUEATH the following specific legacies free of duty:

    1. My gold watch and large tray, which belonged to my father to Dominic Thompson, care of Mrs. Paul Dessain, Shaw House, Uckington Tarporley, Cheshire.

    2. My Oil Paintings of "A Man lying on grass" and of "Barcelona Cathedral", my pencil sketch of a head by Camilla Brown, all my guns, my personal jewelry, and cigarette case, and other articles which are essentially a mans property (except such articles hereby or by any Codicil hereto specifically bequeathed to any other any person) to Simon Ward Thompson, or if he shall have predeceased me, or in respect of any items included in this bequest which he does not require, to Christopher Cox, of Yew Tree Cottage, Broom, Warwickshire, except the two said oil paintings, which in either of such events, I BEQUEATH to Camilla Brown, of Millbank High Flatts, Huddersfield, Yorkshire, AND I DIRECT that the decision of my Trustees as to what is deemed to be included in this bequest shall be final and binding on my Estate, and all persons interested therein.

    3. My pink jade figure, my red and gold china bowl, my oil painting of "Toarmina", and three small circular paintings, to the said Camilla Brown.

    4. My three signed sketches of horses by A. J. Munnings, to Brigadier C. B. Harvey D.S.O. of Oddington Top Moreton-in-Marsh, Gloucestershire.

    5. My Ivory Horse in box to Mildred Hazel Hunter, of Crosshills, Sutton Thirsk, Yorkshire.

    6. My small Gold and Silver cigarette case to Norman Wright, of 18 Pitt Street, Kensington, London W.8..

    7. My oil painting "Waiting for the Carriage" to Jean Parrington, of Field Cottage, Borrowby, Thirsk, Yorkshire.

  4. I BEQUEATH the following pecuniary legacies free of duty:

    1. To the said Jean Parrington, Mildred Hazel Hunter, and Henry Adlam, the sum of hundred pounds each.

    2. To the Secretary, for the time being, of The Bath Club, of 41 Brooke Street, London W.1., for the Servants Fund to be applied at the next Christmas Subscription List after my death, the sum of twenty five pounds, AND I DECLARE that a receipt purporting to be signed by the Secretary of the said Club shall be a sufficient discharge to my Trustees in respect of such sum.

    3. To Messers Weatherby and Sons, of 42 Portman Square, London W.1., the sum of Twenty Five pounds, to be applied to The Rous Memorial Fund, AND I DECLARE that a receipt purporting to be signed by the Secretary or other proper Officer of Messers Weatherby & Sons, shall be a sufficient discharge to my Trustees.

    4. To The Association of Retired Naval Officers, of 175 Piccadilly, London W.1., The Royal Naval Benevolent Society, of 1 Fleet Street, London E.C.4, and King Edward VII Hospital for Officers, of Beaumont House, Beaumont Street, London W.1., the sum of twenty five pounds each, for such of the respective purposes of such Societies and Hospital, as are Charitable, but otherwise without any restrictions, in memory of Lieutenant Commander Ward Thompson, Royal Navy, AND I DECLARE that a receipt purporting to be signed by the Secretary or other proper Officer of such Societies and Hospital, shall be a sufficient discharge to my Trustees.

    5. To each Domestic Servant in my full time employment, at the date of my death, and not under notice to leave, whether given or received, the sum of Fifty pounds for each year during which he or she shall have been in my employment, or the sum of Five hundred pounds, whichever shall be the less.

  5. I BEQUEATH, free of duty, all my Presentation Trophies, and books, and photographs, which my trustees consider may be of interest or value in future years, to the said Simon Ward Thompson, or if he shall die before me, to my God-son Thomas Parrington, of 61 Cadogan Gardens, London S.W.3

  6. I BEQUEATH, free of duty, to the said Simon Ward Thompson, my shares in The Baths Club Company, my Leasehold House, and premises, known as 14 Pont Street, Mews, Chelsea, aforesaid, and all my articles of household or domestic use or ornament, not hereby, or by any Codicil, hereto otherwise disposed of, AND I express the desire (without creating any legal obligation) that if the said Simon Ward Thompson should decide to dispose of the said Leasehold House and Premises, he will allow the said Camilla Brown to take without cost, any of the said articles of household or domestic use or ornament which he shall not intend to keep, and which she shall wish to take.

  7. I DEVISE AND BEQUEATH all the remainder of my property, of whatsoever nature, and wheresoever situate, unto my trustees, upon trust to sell, call in, and convert into money, the same or such part, or parts thereof as shall not consist of money, with power to postpone such sale, calling in, and conversion, for such time or times as they shall in their absolute discretion think fit, without being liable for loss, and after payment thereout of my funeral and testamentary expenses and just debts, to stand possessed thereof, and of the investments, for the time being representing the same (hereinafter called "my residuary estate") upon the following trusts:

    1. As to twenty thousand pounds for the said Simon Ward Thompson, if he shall survive me, and attain the age of twenty five years, but if he shall die before me, or before attaining the age of twenty five years, the same shall (subject as hereinafter mentioned) fall into, and form part of, the remainder of my residual estate, to be divided in accordance with sub-clause (c) of this clause.

    2. As to Ten thousand pounds for the said Camilla Brown, if she shall survive me, and attain the age of twenty five years, but if she shall die before me, or before attaining the age of twenty five years, the same shall (subject as hereinafter mentioned) fall into, and form part of, the remainder of my residual estate, to be divided in accordance with sub-clause (c) of this clause.

    3. As to the remainder of my residuary estate, upon trust, for, and equally between, such of my God-children,
      Pauline Hancock, of Yew Tree Cottage, Broom, aforesaid,
      Mary Withycombe, of Providence House, Sutton Thirsk, aforesaid,
      Olivia Blood, of Little Todgers, Westward Lane, West Chiltington, Pulborough, Sussex, and
      Charles Lowder, of 20 Sussex Mansions, Old Brompton Road, London S.W.7,

      as shall survive me and attain the age of twenty five years, PROVIDED nervertheless that if any Beneficiary under this clause shall die before me, or survive me, but die before attaining the age of twenty five years, leaving issue who shall be living at the date of the survivor of myself, and such Beneficiary, and shall attain the age of twenty five years, such issue shall take in equal shares, per stirpes if more than one, the share of my residuary estate, whether original, or accrued, which his or her, or their parent, would have taken, if such parent had survived me and attained the age of twenty five years, PROVIDED ALSO that any contingent gift, given by this clause, shall carry the intermediate income.

  8. I DECLARE that the perpetuity period applicable to any disposition under this my Will shall be eighty years from the date of my death.

  9. I DECLARE that my Trustees shall have full power, in their absolute discretion (without being responsible for any loss thereby incurred) to invest any money subject to the trusts of this, my Will, in any investments or securities including real property or leaseholds having not less than sixty years to run (whether for investment or for occupation by a beneficiary), notwithstanding that the same may not be authorised by law for the investment of trust funds, to the intent that my Trustees shall have the same full and unrestricted powers of investing and transposing investments, in all respects, as if they were entitled thereto beneficially, and also that my Trustees may retain all the investments held by me at the date of my death, should they consider such retention advisable, but my Trustees shall not be liable for any loss incurred by the retention of such investments.

  10. I DECLARE that all income shall be treated as income of the day on which the same shall be received by my Trustees, or any Agent on their behalf, and the Apportionment Act of 1870 shall not apply.

  11. ANY Executor or Trustee of this my Will, being a Solicitor, or other person engaged in any profession or business shall be entitled to charge and be paid all usual professional or other charges for any business or act done by him or his firm, in connection with the administration of my estate, and the trusts hereof, including acts which an Executor or trustee not being engaged in such profession or business could have done personally.

THIS IS A CODICIL to the last Will and Testament, dated the Seventh day of March, One thousand nine hundred and sixty six, of me Charles Ralfe Thompson C.M.G. O.B.E. of 14 Pont Street Mews, Chelsea, London S.W.1 Commander Royal Navy (Retired).

  1. I REVOKE Clause 7 of my said Will.

  2. I BEQUEATH free of duty, to Simon Ward Thompson, provided that he shall survive me and attain the age of twenty five years, a sum equivalent to the Policy monies payable on my death, less any Estate Duty payable thereon, under Policy number 274984, with the National Provident institution effected by me in favour of Trustees on behalf of Camilla Brown or other persons in certain events.

  3. I DEVISE AND BEQUEATH all my property of whatsoever nature and wheresoever situate not otherwise specifically disposed of by my said will or any Codicil thereto unto my Trustees, upon trust, to sell call in, and convert into money, the same or such part, or parts thereof as shall not consist of money, with power to postpone such sale, calling in, and conversion, for such time or times as they shall in their absolute discretion think fit, without being liable for loss, and after payment thereout of my funeral and testamentary expenses and just debts, to stand possessed thereof, and of the investments, for the time being representing the same (hereinafter called "my residuary estate") upon the following trusts:

    1. As to two thirds thereof for the said Simon Ward Thompson, if he shall survive me, and attain the age of twenty five years, but if he shall die before me or before attaining the age of twenty five years, the same shall (subject as hereinafter mentioned) fall into and form part of the remainder of my residuary estate, and be held upon the trusts, declared by Sub-clause (b) of this clause.

    2. As to the remaining one third thereof for Camilla Brown if she shall survive me, and attain the age of twenty five years, but if she shall die before me or before attaining the age of twenty five years, the same shall (subject as hereinafter mentioned) fall into and form part of the remainder of my residuary estate, and be held upon the trusts, declared by Sub-clause (a) of this clause.

    3. Subject as aforesaid upon trust for and equally between The Association of Retired Naval Officers, The Royal Naval Benevolent Society, and King Edward VII Hospital for Officers, AND I DECLARE that a receipt purporting to be signed by the Secretary or other proper Officer of such Societies and Hospital shall be a sufficient discharge to my trustees.

  4. I DIRECT that not withstanding anything hereinbefore mentioned if any Beneficiary under this Codicil shall die before me or survive me but die before attaining the age of twenty five years, leaving issue who shall be living at the date of the survivor of myself, and such Beneficiary, and shall attain the age of twenty five years, such issue shall take in equal shares, per stirpes if more than one, the benefit under this Codicil, whether original or accrued, which his, her, or their parent, would have taken, if such parent had survived me, and attained the age of Twenty Five Years.

  5. I DIRECT that any contingent gift, given by this Codicil, shall carry the intermediate income.

  6. IN all other respects, I confirm my said Will.

On the 15th day of November 1966 Probate of this will, with one codicil was granted at Durham to Trevor Bertram Birkett, and Henry Amyas Adlam, the executors.
