The Will of Charles Elliot Thompson 1855 - 1910 Dated 27 May 1907

This is the last Will of me, Charles Elliot Thompson of the Poplars, Sunderland, in the County of Durham, Shipowner.

I appoint my sons Charles Elliot Thompson and Joseph Lowes Thompson, to be Trustees and Executors of this my will, and I also appoint my son Allan Robert Thompson on his attaining his majority to be a Trustee and Executor of this my Will jointly with my said sons Charles Elliot Thompson and Joseph Lowes Thompson,

but so that the Trust Estate will not vest in the said Allan Robert Thompson until he attains the age of twenty one years, and that my sons Charles Elliot Thompson and Joseph Lowes Thompson may act in the meantime as fully and effectively as if they were the only Executors and Trustees appointed by this my Will,

and my sons Charles Elliot Thompson and Joseph Lowes Thompson during the minority of my said son Allan Robert Thompson and after his majority my said son Allan Robert Thompson jointly with them shall be hereinafter referred to as the case may be as "my Trustees".

I give devise and bequeath all my real and personal property whatsoever, and wheresoever, or over which at the time of my decease I shall or may have any disposing power, unto my trustees upon trust, to divide the same among my said sons Charles Elliot Thompson, Joseph Lowes Thompson, and Allan Robert Thompson in equal shares,

provided always that if any of them shall die in my lifetime leaving a child or children who shall survive me, and being a son, or sons shall attain the age of twenty one years, or being a daughter or daughters shall attain that age or marry under that age, then and in every such case the last mentioned child or children shall take (and if more than one equally between them) the share which his, her, or their parent would have taken, of and in my trust estate if such parent had survived me and attained the age of twenty one years,

And I declare that my trustees may permit any part or part of my trust estate that may be invested with The Wearmouth Foundry Company Limited or any other money invested in any other Partnership Limited Liability or other Company or Business, or in any Ship or Ships or other investment not being a proper Trust Investment to remain in or upon the state or investment as the same may be at the time of my decease without being responsible for any loss resulting therefrom until my said son Allan Robert Thompson attains the age of twenty one years and my Estate is divided as aforesaid.

This is a Codicil to my Will herein written.
Whereas I have advanced to my son Charles Elliot, on his marriage, money for the purchase of his house, land, and furniture, now I desire that he shall account for such advances in the division of my estate, so that the shares of my sons Joseph Lowes and Allan Robert, shall be made equal with that of my said son Charles Elliot.

In all other respects I confirm my said Will. In witness whereof I have hereunto set my hand this 11th day of May 1909. - Charles E. Thompson
